Right of Withdrawal

The Serbian Consumer Protection Act, for distance contracts, grants the Consumer (a natural person who acquires the service for purposes outside of a trade, business, craft or profession) the right to withdraw from the contract within 14 days of the conclusion of the contract, without giving a reason.
A withdrawal notice takes legal effect on the date it is sent to Auto Konekt (when it concerns the Connection Service) or to the Service Provider (when it concerns the Service).
Specifics for service contracts: loss of the right of withdrawal
For contracts for the provision of services (such as the Service ordered through the Platform), the Consumer loses the right of withdrawal once the service has been fully performed, provided that the Consumer has previously:
- expressly requested that the performance of the service begin before the 14-day period expires, and
- acknowledged that the right of withdrawal is lost upon full performance of the service.
The Consumer makes these declarations by accepting the Terms of Use upon registration, and the consent applies to all future Services ordered through the Platform for as long as the Terms remain accepted and in force. The text of the express consent is in Section 7 of the Terms of Use.
If, at the time of withdrawal, the Service has been partly performed, the Consumer owes a proportionate amount for the part performed.
How to submit a withdrawal notice
The Consumer may submit a withdrawal notice:

The notice may be in free form or use the form provided at the end of this document. The withdrawal period is deemed to have been observed if the notice is sent before the period expires.
Refunds
Auto Konekt will refund the amount paid by the Consumer without delay, and at the latest within 14 days from the receipt of the withdrawal notice. The refund is made using the same payment method used for the original transaction, unless the Consumer expressly agrees to a different method, and at no cost to the Consumer.
If payment was made by card, the refund is made exclusively through VISA, MasterCard, Maestro, or Dinacard, meaning that the acquiring bank, on Auto Konekt's instruction, will refund the funds to the Consumer's card. In this process, Auto Konekt acts as the recipient of payment in the name and for the account of the Service Provider.
Exceptions
The right of withdrawal does not apply, in particular, in the following cases:
- to contracts for the provision of services that have been fully performed with the prior express consent of the Consumer and the Consumer's acknowledgment that the right of withdrawal is lost upon full performance;
- to the supply of goods made to the Consumer's specifications or clearly personalised;
- to the supply of sealed goods that cannot be returned for reasons of health protection or hygiene, and that have been unsealed after delivery.
